Semirara moves to secure P14-B loan for power project

SEMIRARA MINING Corp. has moved to pledge a bulk of its voting shares in a subsidiary to guarantee repayment of a P14-billion loan from BDO Capital & Investment Corp., a disclosure on Friday showed.

Semirara Mining seals deal for P11.5-B power plant loan

Tax decision affirmed


THE COURT of Tax Appeals (CTA) has affirmed its earlier resolution directing the Bureau of Internal Revenue (BIR) to refund a local mining firm’s withholding tax payment worth over P15 million. In a decision promulgated on March 22, the CTA full court denied the BIR’s petition for review of the court’s Jan. 4 decision and March 18 resolution issued last year directing it to “refund or issue [Semirara Mining Corp.] a tax credit certificate... in the amount of P15,292,054.91, representing the final withholding value-added tax (VAT).” The court was referring to the VAT on the firm’s sales of coal in January 2007, “which the National Power Corporation (NPC) erroneously withheld and remitted to the [BIR] on February 9, 2007.” Citing the CTA First Division’s earlier decision on the case, the court ruled that there was no indication that Republic Act 9337, which indicates VAT-exempt transactions, had already repealed Presidential Decree 972, or the Coal Development Act of 1976.Pointing out that the bureau did not act on Semirara’s administrative claim “for almost two years,” the court said it was further erroneous for the BIR to argue that Semirara failed to exhaust all available remedies.

i'm considering buying this stock for dividend play. at the current price, 4.76% yung cash dividend. parang mejo mataas nga lang yung adjusted P/E Ratio nya which is 20. pero kung breakout na nga to, more reasons to buy it. Smile

pd. no SCC yet
